The Montgomery County Department of Health and Human Services Office of Public Health (MCOPH) conducted an unannounced retail food inspection on 6/22/2020. As a result of that inspection, and due to the severity of the specific violations Luly’s Kitchen Latin Flavor was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 13 violations were found and include one or more violations determined to be food borne illness risk factors.

The inspector made the following comments in support of the violations found during the inspection:

  • Failure to comply with directives – facility was ordered to cease use of warewashing machine during inspection dated 12/05/2019. Facility was instructed at time of said inspection that unit may not be placed back into service until serviced by a professional, and a completed work order was submitted to MCOPH, AND facility received written permission from MCOPH to return unit to normal service. Unit observed in operation during inspection. Unit observed dispensing an approved amount of sanitizer at time of inspection. Facility may return unit into normal use. Facility may face legal action for failure to comply with directives.

  • Facility currently lacks a valid MCOPH food establishment license. Facility is hereby given 48 hours to submit invoice with payment to MCOPH. EHS e-mailed facility current invoice during inspection. Failure to return invoice with payment within established timeframe may lead to closure of facility.

  • Facility observed not posting CFSM certificate publicly at time of inspection.

  • (2 times repeat violation) Opened employee beverages stored on equipment and adjacent to utensils in kitchen area. Failure to correct and maintain multiple repeat violations may lead to legal action.

  • Spoon observed being stored in handwashing sink at cook’s line. Hand washing sinks are to be used for handwashing only. Facility relocated spoon to three-compartment sink to be washed, rinsed and sanitized.

  • Facility observed lacking means of drying hands at front counter handwashing sink and toilet room handwashing sink.

  • Sanitizer bucket and partially-filled sanitizer compartment of three-compartment sink observed lacking detectable concentration of quaternary ammonium sanitizer. Facility added sanitizer during inspection.

  • 1 package of Hot Shot branded insecticide fogger observed in front service area. This product is not permitted for use in a food establishment. Facility removed product during inspection.

  • Foods packaged for customer self-service in retail refrigerator lacking retail labeling. Facility was emailed MCOPH retail labeling guidelines during inspection.

  • Front door propped open at time of inspection and lacks screen or air curtain. (allows access to restaurant for vermin)

  • Employee purse stored amongst food items on dry storage rack.

  • Food handlers observed lacking effective hair restraints at time of inspection.

  • (3 times repeat violation) Front counter area handwashing sink not sealed to wall. Failure to correct and maintain multiple repeat violations may lead to legal action.
