12 violations at Tony’s on the Mountain in Tannersville’s; Live dog observed on the premise of the food facility in the back dry storage area

The Pennsylvania Department of Agriculture’s Bureau of Food Safety and Laboratory Services conducted an unannounced retail food inspection on 6/17/2020. As a result of that inspection, and due to the severity of the specific violations  Tony’s on the Mountain was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 12 violations were found.

The inspector made the following comments in support of the violations found during the inspection:

  • The Person in Charge did not demonstrate adequate knowledge of food safety in this food facility as evidenced by this non-compliant inspection.
  • Bulk salt observed in the back prep storage table area, observed contaminated from spillage into container and is adulterated. Food was voluntarily disposed of during this inspection and container cleaned and sanitized.
  • Observed in-use knives stored between table edges and bane marie an area not easily cleanable & sanitized.
  • Observed insecticides not labeled by the manufacturer as approved for use in a food facility. Insecticides were voluntarily removed from the facility
  • Common bowls, with no handle, observed stored in bulk food containers in back prep area. ( would result in hands coming into contact with food)
  • Non-food contact surfaces not cleaned at a frequency to preclude accumulation of dirt and soil on bane marie.
  • Food employees observed in food prep area, not wearing proper hair restraints, such as nets or hats.
  • Meatballs and sauce, which was cooled, was not reheated to 165°F within two hours, for hot holding. Person in charge reheated meatballs and sauce above 165*F during this inspection for immediate corrective action. (see note below)
  • Live dog observed on the premise of the food facility in the back dry storage area. Dog was removed from the facility at the time of this inspection.
  • Refrigerated ready to eat, time/temperature control for safety food prepared in the food facility and held for more than 24 hours, located in the storage refrigerator, is not being date marked.
  • Food facility does not have available sanitizer test strips or test kit to determine appropriate sanitizer concentration
  • Cutting board and bane marie station, a food contact surface, was observed to have food residue and was not clean to sight and touch.
  • Working containers in front service area, used for storing chemicals, cleaners taken from bulk supplies, were not marked with the common name of the chemical.
