The Montgomery County Department of Health and Human Services Office of Public Health (MCOPH) conducted an unannounced retail food inspection on 2/20/2020. As a result of that inspection, and due to the severity of the specific violations the Michaels Family Restaurant was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 34 violations were found and include one or more violations determined to be food borne illness risk factors.

The inspector made the following comments in support of the violations found during the inspection:

  • Facility is lacking a written vomit/fecal incident procedure at time of inspection. Sample document emailed to facility.

  • (2 times repeat violation)Employee beverages stored on and above food prep surfaces throughout facility. Some beverages found uncovered with employees observed drinking from open cups in kitchen. Failure to correct and maintain multiple repeat violations may result in further legal action.

  • Employee bag of food found stored on prep table next to slicer.

  • Employees observed dumping ice in front counter area hand wash sink.

  • Hand wash sink at kitchen entrance observed spraying at faucet causing water to leak onto floor. Facility repaired during inspection.

  • Basement prep room hand wash sink found obstructed by boxes with metal scrubber and can opener in sink basin.

  • 1No hand wash reminder sign posted at basement prep room hand sink.

  • Employee observed washing a large pot in 3 compartment sink then walking to place in storage without sanitizing. No sanitizer was set up in 3 compartment sink. Facility was instructed on proper wash, rinse, sanitize, and air dry procedures during inspection.

  • At beginning of inspection facility lacking sink stoppers for use of 3 compartment sink. Facility obtained sink stoppers and was instructed that at least two sink stoppers must be available at all times of operation.

  • Facility lacking any date marking of prepared and opened TCS foods in walk-in refrigerators. Facility emailed date marking regulations during inspection.

  • ROP fish in 2 door under counter refrigerator on cook’s line fully thawed with out removing product from vacuum sealed package before defrosting. Facility voluntarily discarded fish during inspection.

  • Rodent-like droppings observed in basement in storage room, prep room, and employee bathroom with droppings observed on floor mixer. Live rodent-like animal observed in basement. Facility must clean and sanitize all areas and have licensed pest control service. Send pest control report to fax or email provided within 10 business days. Pest control report must state treatment of target pest.

  • Foods stored on the floor of walk-in refrigerators and walk-in freezer.

  • Employee observed slicing hard-boiled eggs in walk-in refrigerator. This area is not approved for food preparation and all prep is to occur in kitchen areas with access to hand wash sink.

  • Food handlers lacking hair restraints.

  • Wet rags observed wedged in crevice of dish machine door at top of machine.

  • Wet rags observed wedged in crevice of hot holding cabinet doors at bottom of units on cook’s line.

  • Tongs stored on oven handle.

  • Knife stored in hard-boiled egg container in walk-in refrigerator.

  • Open cans of food items in waitstaff prep refrigerator not transferred into a sealed food grade container after opening.

  • Ice accumulation observed on interior of walk-in freezer.

  • Many surfaces on cook’s line lined with absorbent cardboard.

  • Some equipment on cook’s line observed with aluminum foil lining.

  • Facility found to be saving egg crates and using for lining surfaces on cook’s line. Egg crates must be discarded after all eggs are used.

  • Yellow tape material observed on walk-in refrigerator door handle.

  • Pipe under hand wash sink by 3 compartment sink observed leaking. Facility repaired during inspection.

  • Pipe under upstairs 3 compartment sink on right end basin observed wrapped in plastic. No active leaking observed during inspection.

  • Floor drain near food prep sink on cook’s line observed with a plastic bag in drain not allowing for proper drainage. Facility removed bag.

  • Men’s room urinal not functioning at time of inspection.

  • No covered trash can provided in employee restroom.

  • Wall damage observed under dry storage shelving in basement storage room with large holes at bottom of walls with cove base missing.

  • (2 times repeat violation)Room across from dry storage area in basement with food, equipment and sinks along with office printer. Facility is now using this prep room for use of floor mixer. Facility must remove all non-food related items from side prep room and maintain area in clean condition. Facility removed office items and cleaned room during inspection. Failure to correct and maintain multiple repeat violations may result in further legal action.

  • One light shield missing and one light shield damaged on ceiling lights above cook’s line.

  • Employee personal clothes and bags observed stored in several areas of facility where food prep and storage occur (dry storage shelving, prep table, etc). Facility currently does not have a designated area to store employee personal items.
