The Montgomery County Department of Health and Human Services Office of Public Health (MCOPH) conducted an unannounced retail food inspection on 3/5/2020. As a result of that inspection, and due to the severity of the specific violations the Drake Tavern in Jenkintown was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 35 violations were found and include one or more violations determined to be food borne illness risk factors.

The inspector made the following comments in support of the violations found during the inspection:

  • Food operational license not posted in public view.

  • Sign stating inspection reports are available upon request not posted in public view.

  • CFSM certificate not posted in public view.

  • Facility is lacking a written vomit/fecal incident procedure at time of inspection. Sample document emailed to facility.

  • 6 – proper eating, tasting, drinking or tobacco use

    Comments: (2 times repeat violation)Employees observed drinking from open beverage cups in kitchen while preparing foods. Employee beverages stored on food prep surfaces and with clean utensils throughout facility. Failure to correct and maintain multiple repeat violations may result in further legal actions.

  • No soap provided at bar hand wash sink.

  • Dumping of ice and drinks observed in server station hand wash sink.

  • No hand wash reminder signs posted at server station hand wash sink or kitchen hand wash sink by entrance.

  • No hot water supplied to hand was sink at kitchen entrance. A 24 hour follow-up inspection will be conducted to verify hot water supply has been restored.

  • No paper towels provided at either of the hand washing sinks in kitchen. Paper towel dispenser in back area of kitchen not operational during inspection.

  • Hand wash sink at kitchen entrance observed with food debris and draining very slowly. A 24 hour follow-up inspection will be conducted to verify sin is capable of properly draining.

  • 3 compartment sink quaternary sanitizer tested at 0ppm. Facility remixed a 200ppm solution during inspection.

  • At beginning of inspection no sanitizer solution was supplied to in-use dish machine. Facility replaced sanitizer and a final rinse of 50ppm was supplied to machine.

  • Several prepared and opened TCS foods inside of main prep walk-in refrigerator are being stored past 7 day maximum discard date on label. Facility voluntarily discarded all foods in unit past 7 day discard date.

  • Soap squeeze bottles not labeled at bar and kitchen hand wash sink by entrance.

  • Dessert prep refrigerator recorded with ambient temperature of 49F. Foods in unit recorded with internal temperatures of 46F. Ice accumulation observed on back interior of unit. Facility moved all foods to walk-in refrigerator. Facility must immediately stop using the unit. Facility may not use the unit until serviced by licensed professional, AND unit is operating at 41F or below, AND written permission is granted by MCOPH.   • Facility lacking a probe thermometer to take internal food temperatures.

  • Dead rodent-like animal observed on glue trap in basement under stairs.

  • Rodent-like droppings observed in basement areas with heavy concentration on ledge near stairs. Facility must clean and sanitize all areas and have licensed pest control service. Send pest control report to fax or email provided within 10 business days. Pest control report must state treatment of target pest.

  • Dead cockroach-like insects observed on glue traps in basement by stairs. Facility must clean and sanitize all areas and have licensed pest control service. Send pest control report to fax or email provided within 10 business days. Pest control report must state treatment of target pest.

  • Food handler lacking a hair restraint in kitchen.

  • Bottom shelf of prep table near ware washing area observed with metal peeling up and food residue accumulation.

  • Ice/frost accumulation observed inside of table-top dessert freezer.

  • Ware washing machine drain board with black accumulation on caulk and some caulk missing.

  • Facility lacking quaternary test strips.

  • Sanitizer solution at three basin sink with food debris and oil accumulation.

  • Walk-in freezer floor observed with debris encrusted inside of floor mats and debris on floor under shelving.

  • Door gaskets with accumulation on all outside walk-in refrigerators and walk-in freezer.

  • Mop sink observed obstructed by white plastic sheet and black crate filled with wet mops. Facility manager was unaware of what the white plastic sheet is used for. Mop sink must be accessible at all times.

  • Soda gun holster drain line disconnected at interior side of bar.

  • Wall under left end of 3 compartment sink observed repaired with metal sheets taped on to the wall with black tape.

  • Floor of main food prep walk-in refrigerator lined with absorbent cardboard materials.

  • Damaged floor observed at walk-in freezer floor threshold. Provide smooth, non-porous, easily cleanable surface.

  • Wet mops stored inside mop sink basin.

  • Employee cell phone stored on prep table by dessert area.
