The Montgomery County Department of Health and Human Services Office of Public Health (MCOPH) conducted an unannounced retail food inspection on 6/25/2020. As a result of that inspection, and due to the severity of the specific violations Chef Vargas was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 8 violations were found and include one or more violations determined to be food borne illness risk factors.

This most recent inspection marks the seventh time Chef Vargas has not been, “In Compliance” during an inspection. The restaurant has not passed an inspection since at least December 2016 according to reporting by The Philadelphia Inquirer:

  • Dec 21, 2016- 5 violations including 1 food borne illness risk factor violation.
  • May 17, 2017- 4 violations including 1 food borne illness risk factor violations.
  • Oct 18, 2017- 7 violations including 2 food borne illness risk factor violations.
  • Aug 22, 2018- 11 violations including 8 food borne illness risk factor violations.
  • Apr 26, 2019- 14 violations including 6 food borne illness risk factor violations.
  • Oct 23, 2019- 5 violations including 3 food borne illness risk factor violations.

The inspector made the following comments in support of the violations found during the inspection:

  • Soiled cutting board and knife stored in hand washing sink.
  • No soap provided at hand washing sink.
  • Wall mounted dicer observed with dried potato residue.
  • Cooked potatoes cooked earlier this morning recorded with internal temperature of 74F. Facility voluntarily discarded potatoes. Foods must be cooled from 135F to 70F within 2 hours and from 70F to 41F within an additional 4 hours for a total of 6 hour cooling time.
  • Cooked onions recently prepared recorded with internal temperature of 88F in top portion of prep refrigerator. Foods must be properly cooled to 41F before placing into food prep refrigerator as this unit is not designed for rapid cooling.
  • Shrimp found thawing in food prep sink not under running water.
  • Wet wiping cloths not stored in sanitizer between use.
  • (2 times repeat violation)Unisex employee restroom lacking covered trash receptacle. Facility placed trash can in bathroom during inspection. Failure to correct and maintain multiple repeat violations may result in further legal action.
