The Montgomery County Department of Health and Human Services Office of Public Health (MCOPH) conducted an unannounced retail food inspection on 3/3/2020. As a result of that inspection, and due to the severity of the specific violations the 309 Deli was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 8 violations were found and include one or more violations determined to be food borne illness risk factors.

The inspector made the following comments in support of the violations found during the inspection:

  • Milk at coffee area for customers observed with sell by date of 02/27/2020. Facility voluntarily discarded during inspection.
  • Ice machine observed unclean at time of inspection. Clean and sanitize in accordance with owner’s manual.
  • (2 times repeat violation) Fish filets and kielbasa in pan at steam table observed with internal temperatures below an approved level – 105-115F. Facility voluntarily discarded remainder of product during inspection. Failure to correct and maintain multiple repeat violations may lead to legal action.
  • Unlabeled chemical spray bottle observed at point of sale area.
  • (3 times repeat violation) Packaged foods retail counter missing complete required retail labeling information. Facility was emailed retail labeling regulations during inspection. Failure to correct and maintain multiple repeat violations may lead to legal action
  • Knives stored in crevice in rear prep area. Facility cleaned, sanitized, and relocated items during inspection.
  • Facility observed lining pans with foil at steam table.
  • Mop and mop bucket stored outside of facility back door.
