Tony’s Pizza in Middletown slapped with 10 violations following restaurant inspection; no soap at hand wash sink

The Pennsylvania Department of Agriculture’s Bureau of Food Safety and Laboratory Services conducted an unannounced retail food inspection on 6/5/2020. As a result of that inspection, and due to the severity of the specific violations Tony’s Pizzeria was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 10 violations were found.

The inspector made the following comments in support of the violations found during the inspection:

  • Observed raw chicken that has been repackaged by the food facility being stored in the Bain Marie unit nearest the pizza oven without date marking.
  • Table Top Can Opener Blade, a food contact surface, was observed to have food residue and was not clean to sight and touch.
  • The Person in Charge does not have adequate knowledge of food safety in this food facility as evidenced by this non-compliant inspection.
  • 3-bay sink in food preparation area, which is also being used for food preparation, does not have an adequate air gap between the waste pipe and flood rim of the waste receptor.
  • Mops are not being hung to air dry.
  • Sliced capocollo, a time/temperature control for safety food, was held at room temperature for an unknown amount of time at the deli slicer in the food preparation area. Initial temperature was recorded using an infrared thermometer. Ice was unavailable for confirming accuracy of dial thermometer, and food facility owner declined the offer to check accuracy using boiling water. Internal temperature of a solid piece of the food item in question was recorded using a dial thermometer at approximately 10:50 AM with a reading of 63°F. Owner of food facility voluntarily disposed of the food item in question and estimated the value to be $21.00. (see note below)
  • Time in lieu of temperature being used in the food facility to control ready to eat potentially hazardous foods without written procedures or documentation to verify disposition of food.
  • Soap was not available at the handwash sink in the food preparation area.
  • Both Men’s and Women’s toilet rooms do not have a self-closing door.
  • Paper towel dispenser empty at the handwash sink in the men’s restroom.
