16 violations at Dim Sum Factory in Horsham; bumbles re-inspection; Employee shoes stored on covered container of food in dry storage area

The Montgomery County Department of Health and Human Services Office of Public Health (MCOPH) conducted an expected re-inspection on 7/8/2020 following receipt of a complaint. As a result of that inspection, and due to the severity of the specific violations the Dim Sum Factory was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 16 violations were found and include one or more violations determined to be food borne illness risk factors.

The Dim Sum Factory has now failed to be found, “In Compliance” during three inspections since their opening in November 2019:

  • Oct 31, 2019- site evaluation inspection found NO violations
  • Nov 12, 2019- opening inspection found 3 lower level, “Lack of Good Retail Practices” violations meaning the restaurant was, “In Compliance.”
  • Dec 13, 2019- A routine inspection found 22 violations, 9 of which were classified as, “food borne illness risk factor” violations. 
  • Dec 30, 2019- Re-inspection finds 2 violations with one, “food borne illness risk factor” violation.
  • Jun 17, 2020- Complaint inspection finds 19 violations, 7 of which were classified as, “food borne illness risk factor” violations. (see story below)

The inspector made the following comments in support of the violations found during the inspection:

  • Employee waterbottle stored on cutting board at cook’s line.

  • Handsoap and paper towels observed at cook’s line dump sink. This sink is not a designated handwashing sink. Handwashing is to be conducted at designated handwashing sinks only.

  • (2x Repeat) Uncovered flour bag observed in dry storage area and uncovered bulk foods observed in bottom storage shelf of prep refrigerator. Failure to correct and maintain multiple repeat violations may lead to further legal action.

  • Chlorine concentration observed at less than 50ppm at warewashing machine in kitchen. Facility must cease use of ware washing machine. Facility may not use unit until serviced, supplying final rinse of 50-100ppm chlorine, AND written permission is granted by MCOPH. E-mail report to e-mail address provided at time of inspection.

  • TCS foods observed stored outside of refrigeration at cook’s line lacking time as a public health control log. EHS instructed facility on the establishment of a time as a public health control log during inspection.

  • Facility observed thawing beef in plastic container on counter at ambient temperature. Facility instructed to thaw foods under refrigeration or under cool running water. Facility returned item to food prep sink to thaw under cool running water, but was found to have turned water off at multiple points during inspection.

  • Exterior door in kitchen observed open with screen curtain in place. Screen curtain does not adequately protect facility from entry of pests or animals when exterior door is open.

  • (3x Repeat) Numerous containers of food stored on floor in kitchen area. Failure to correct and maintain multiple repeat violations may lead to further legal action.

  • Plastic containers without handles used to scoop bulk foods.

  • Employee shoes stored on covered container of food in dry storage area.

  • Many foods observed being stored directly in grocery-style bags in walk-in freezer. Foods must be stored in food-grade bags or containers.

  • Cleaver stored in crevice of prep tables.

  • Food debris observed on can opener blade at time of inspection. Failure to correct and maintain multiple repeat violations may lead to legal action.

  • Facility observed attempting to use three compartment sink to thaw frozen meats.

  • Exterior dumpster enclosure observed with excessive food and debris accumulation.

  • Dumpster lids observed open at time of inspection
