309 Deli in Hatfield slapped with 12 violations; 5 times Repeat Facility lacks adequate date markings on prepared and/or open TCS food items, Health Department threatens legal action

The Montgomery County Department of Health and Human Services Office of Public Health (MCOPH) conducted an unannounced retail food inspection on 8/17/2020. As a result of that inspection, and due to the severity of the specific violations the 309 Deli was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 12 violations were found and include one or more violations determined to be food borne illness risk factors.

The inspector made the following comments in support of the violations found during the inspection:

  • (2 times repeat violation) Sign stating that inspection reports are available upon request is not posted in public view. Facility located sign during inspection and posted publicly. Failure to correct and maintain multiple repeat violations may lead to legal action.

  • (2 times repeat violation) Facility’s Food Establishment License site observed expired. Facility states that it has contacted MCOPH to obtain duplicate. Contact MCOPH if duplicate license does not arrive. Failure to correct and maintain multiple repeat violations may lead to legal action.

  • Facility currently lacks a certified food safety manager (CFSM) licensed by MCOPH. Facility has an employee with a valid ServSafe certificate. Facility stated that it has mailed copy of certificate and payment to MCOPH’s Norristown office. Contact MCOPH if certificate does not arrive.

  • Opened employee beverage observed being stored on shelf above prep table and prep refrigerator. Facility relocated beverage during inspection.

  • Handwashing sink at kitchen observed slow to drain. Facility states that plumber has been contacted to repair. E-mail service report to MCOPH at e-mail address provided.

  • 1 quart of whole milk observed in display refrigerator with a sell-by date of 08/08/2020. Facility voluntarily discarded product during inspection.

  • Raw shell eggs stored above ready-to-eat food item in rear prep refrigerator. Facility relocated items during inspection.

  • (5 times repeat violation) Facility lacks adequate date markings on prepared and/or open TCS food items. Adequate date markings of prepared TCS foods to be held in facility for longer than 24 hours consist of discard dates not to exceed 7 days from and including date of preparation. Facility observed using prep dates only. EHS e-mailed facility PDA date marking guidelines during inspection. Facility added discard dates to applicable items during inspection. Failure to correct and maintain multiple repeat violations may lead to legal action.

  • Food handlers observed lacking hair restraints at time of inspection. Food handlers donned hair restraints during inspection.

  • 3 basin sink no longer adequately sealed to wall.

  • Facility observed lining some pans with absorbent paper towels during inspection.

  • (3 times repeat violation)No self-closing device on the door of employee toilet room upstairs. Failure to correct and maintain multiple repeat violations may result in legal action or citation.
