The Pennsylvania Department of Agriculture¬† conducted an unannounced retail food inspection on 8/11/2020. As a result of that inspection, and due to the severity of the specific violations Charleys Philly Steaks was cited as being, “Out of Compliance” with Pennsylvania food safety regulations. During this inspection a total of 5 violations were found.

The inspector made the following comments in support of the violations found during the inspection:

  • Food Employee observed eating or tasting food in the back prep area. CORRECTED ON SITE
  • The food facility does not have a certificate for the certified food employee posted in public view. 7TH REPEAT VIOLATION (12/19/16, 12/11/17, 11/8/18, 5/28/19, 11/1/19 & 12/9/19)
  • Observed clean food equipment and/or utensils in storage area, stored wet in a manner that does not allow for draining and/or air drying (wet nesting*).REPEAT VIOLATION (11/1/19)
  • The Food Facility Operator shall be the Person in Charge or shall designate a Person in Charge and shall ensure that a Person in Charge is present at the food facility during all hours of operation. Upon entering facility, agent was informed that there is no manager present. Spoke with employees. CORRECTED ON SITE
  • Black filth observed on the interior of the ice machine underneath at discharge chute & water distribution tubing. DO NOT USE. Please empty ice machine COMPLETELY!! Wash, Rinse and Sanitize all parts and allow to air dry before refilling. This machine WAS NOT cleaned during the time of this inspection and bagged ice will be utilized until approval is obtained. REPEAT VIOLATION (11/1/19)

*Wet nesting refers to the practice of placing two recently-washed items together in a nested fashion, preventing proper airflow. In a moist, dark, low-air environment, unseen bacteria grows unchecked, and suddenly that mixing bowl is a biological incident waiting to happen. Even at high temperatures, the food or ingredients you place on that wet-nested kitchen equipment can act as an accidental insulator, or even as fuel for further bacterial growth.
