The Montgomery County Department of Health and Human Services Office of Public Health (MCOPH) conducted an unannounced retail food inspection on 8/3/2020. As a result of that inspection, and due to the severity of the specific violations the Yellow, Inc was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 21 violations were found and include one or more violations determined to be food borne illness risk factors.

The inspector made the following comments in support of the violations found during the inspection:

  • Food license not posted in public view.

  • Facility has dug a hole into floor of prep area without notifying MCOPH or being granted approval to do so. Hole was put in place for drainage of waste water by facility. Once hole is filled facility scoops water out of hole and dumps it into a floor drain. This is not an approved way of disposing of waste water. All waste water must be properly disposed of in a sanitary manner through proper sewage system. Facility must cease use of hole and provide MCOPH with a scope of work for filling hole and proving smooth, non-porous, easily cleanable surface. A follow-up inspection will be conducted to ensure hole has been filled and surface finishes are approved. Facility may face possible legal action.

  • Many employee beverage containers stored on food prep surfaces and inside refrigeration units.

  • Employee partially eaten food bowl found on prep table.

  • Hand wash sink by food prep sink lacking paper towels.

  • Cold water at hand wash sink by food prep sink found turned off at time of inspection. Facility was instructed that all hand sinks must be supplied with hot and cold running water.

  • Minced garlic in oil in gallon jug marked keep refrigerated was stored at room temperature by cook’s line. Facility voluntarily discarded.

  • Some TCS foods out in retail area observed still out for retail sale past 4 hour allowed time stamp on label. Facility voluntarily discarded and replenished foods with fresh food items.

  • At beginning of inspection 2 door under counter sliding door refrigerator recorded at 50F ambient temperature with foods inside of unit at 47F internal temperature. Facility moved all foods to a working refrigerator. By end of inspection facility was able to adjust refrigerator to 40F ambient temperature and was granted permission to use unit again.

  • Frozen dumplings in clear bags in retail freezer lacking retail labels. Facility had place card with ingredients on unit by due to retail point of sale facility individually label each package. Retail labeling guidelines emailed during inspection.

  • Heavy amount of fruit fly-like insects observed throughout facility with heaviest concentrations observed by pickle barrels in prep area. Facility must have licensed pest control service within 10 business days and send pest control report to email provided. Pest control report must state treatment of target pest.

  • Boxes of cabbage stored on floor with water accumulation surrounding boxes. Cardboard observed soaked in water. Facility voluntarily discarded two boxes of cabbage during inspection.

  • Cups without handles used as scoops for sauces and stored in sauces in prep area.

  • Clean cutting board stored behind food prep sink faucet.

  • Shelving around cook’s line areas observed lined with newspapers.

  • During inspection facility briefly lost hot water supply. Facility was able to supply hot water of 110F at all sinks during inspection.

  • Right side of 2 bay prep sink observed with a leaking pipe. Facility repaired during inspection.

  • Mop sink observed obstructed by large stack of soiled food pans.

  • (2 times repeat violation)Toilet tank lid missing in employee restroom. Failure to correct and maintain multiple repeat violations may result in legal action.

  • Floor of cook’s line observed lined with absorbent cardboard materials.

  • Several areas of floor in facility observed with stagnant water accumulation and food debris build-up. A 24 hour follow-up inspection will be conducted to ensure cleanliness of facility and to access fruit fly-like insect activity in prep area.
